NLRB Issues New Posting Requirement
On August 25, 2011, the National Labor Relations Board (NLRB) adopted a final rule to require that all employers to post a notice of employee rights under the National Labor Relations Act (NLRA).
The required posting informs employees about their right to organize a union, bargain collectively, and engage in other protected concerted activity. The notice also advises employees that they have the right to refrain from engaging in such activities.
In its infinite wisdom, the NLRB has postponed the posting notice from November 14, 2011 until January 31, 2012, It stated that the extension was "in order to allow for enhanced education and outreach to employers, particularly those who operate small and medium size businesses." The new rule is just one of a host of requirements under the NLRA that already apply to all private sector employers.
